These Terms of Service govern access to kousyn.com and purchases from KOUSYN. By using the website or placing an order, you agree to these terms together with the policies linked below. Mandatory consumer rights that cannot legally be excluded remain unaffected.

Eligibility and Accounts

You must have legal capacity to enter a purchase contract in your jurisdiction. If you create an account, you are responsible for providing accurate information, protecting your credentials and notifying us of suspected unauthorised access. We may suspend accounts used fraudulently, unlawfully or in breach of these terms.

Products and Product Information

We make reasonable efforts to describe products accurately. Screen settings, lighting and natural material texture may cause minor colour or grain differences. Measurements may vary slightly because of production methods. These normal variations are not defects when the product remains consistent with its description.

Products and promotions are subject to availability. We may limit quantities, withdraw a product or correct information before accepting an order. Nothing in this section limits rights where a product is materially inaccurate, faulty or not as described.

Pricing, Taxes and Errors

Prices and promotions may change before an order is placed. The price, available shipping charge and any amounts collected by KOUSYN are shown at checkout before payment. International orders may incur duties, VAT, GST, brokerage or import charges as explained in our Shipping Policy.

If there is an obvious pricing, inventory or product-information error, we may correct it and contact you before accepting or dispatching the order. If we cancel an affected order, captured payment for the cancelled item will be refunded. We will not alter an accepted order price without your agreement.

Orders and Contract Formation

Submitting an order is an offer to purchase. An automated acknowledgement confirms receipt but does not necessarily mean the order has been accepted. Acceptance occurs when we confirm fulfilment or dispatch, subject to mandatory law.

We may refuse, limit, hold or cancel an order for legitimate reasons including unavailable inventory, failed payment authorisation, address or delivery restrictions, suspected fraud, misuse of promotions, resale activity, technical errors or breach of these terms. We may request reasonable verification before fulfilment.

Payments

Payments are handled by available third-party processors. You authorise KOUSYN and its processors to charge the amount shown at checkout. You represent that you are authorised to use the selected payment method. Payment-provider terms and fraud controls may also apply.

Shipping and Delivery

Shipping destinations, processing, estimated delivery, tracking, customs, address issues and refused or unclaimed parcels are governed by our Shipping Policy. Delivery estimates are not guaranteed dates, but this does not remove remedies that apply when an agreed or legally required delivery period is not met.

Returns and Refunds

KOUSYN offers a 30-day return request window for eligible products, subject to prior authorisation, strict condition requirements and inspection. Full terms are set out in our Returns Policy. Mandatory withdrawal, guarantee and conformity rights remain unaffected.

Promotions, Discounts and Gifts

Unless expressly stated otherwise, promotions are time-limited, non-transferable, cannot be combined and have no cash value. A discount cannot be added after an order is placed. If a qualifying order is returned, a refund may be recalculated to reflect the promotion and any unreturned gift, to the extent permitted by law. We may cancel promotions affected by error, fraud or misuse.

Reviews and User Content

If you submit a review, photograph, comment or other content, you confirm that it is accurate, lawful and does not infringe another person’s rights. You grant KOUSYN a non-exclusive, worldwide, royalty-free licence to host, reproduce and display that content for operating and promoting the store, subject to applicable privacy law. We may moderate unlawful, fraudulent, irrelevant or abusive content.

Intellectual Property

The website, KOUSYN branding, product photography, graphics, text, layouts and other content are owned by or licensed to KOUSYN and protected by applicable law. You may use the site only for personal, non-commercial shopping. No content may be copied, scraped, republished, sold or commercially exploited without written permission.

Prohibited Conduct

• Using false information, stolen payment methods or another person’s account without authority.
• Submitting fraudulent returns, chargebacks, delivery claims, altered evidence or substituted products.
• Interfering with website security, availability, code, pricing, inventory or checkout.
• Using automated tools to scrape content, create abusive traffic or circumvent purchase limits.
• Using the website or products for unlawful activity or infringement of another person’s rights.

Third-Party Services and Links

Payments, hosting, delivery, analytics and other functions may be provided by third parties. We are responsible for our own obligations but do not control independent third-party websites or their separate terms, privacy practices and services. This section does not exclude responsibility that applicable law places on KOUSYN for fulfilment, delivery or selected service providers.

Disclaimer

To the fullest extent permitted by law, the website is provided on an “as available” basis. We do not guarantee uninterrupted or error-free access, compatibility with every device, or that all non-essential website content will always be current. Product warranties and consumer guarantees required by law are not excluded.

Limitation of Liability

To the fullest extent permitted by law, KOUSYN is not liable for indirect or consequential loss that was not reasonably foreseeable when the contract was formed. For claims relating to an order, our aggregate contractual liability will not exceed the amount paid for the affected order, except where a greater remedy is required by law.

Nothing in these terms excludes or limits liability for fraud, fraudulent misrepresentation, wilful misconduct, gross negligence, death or personal injury caused by negligence, defective-product liability that cannot be excluded, or any other liability or consumer remedy that applicable law does not allow us to limit.

Events Outside Reasonable Control

We are not responsible for delay caused by events outside our reasonable control, including severe weather, customs disruption, carrier interruption, strikes, government restrictions, infrastructure failure or similar events. We will take reasonable steps to reduce the effect, communicate material delay and provide cancellation or refund rights where required by law.

Governing Rights and Disputes

Severability and Waiver

If a provision is found unenforceable, it will be limited or removed only to the extent necessary, and the remaining provisions will continue. A delay in enforcing a provision is not a waiver.

Changes to These Terms

We may update these terms prospectively when our services or legal obligations change. The version in effect when an order is placed governs that order unless a change is required by law or agreed with you.
